This article shows the legal problems connected with countering terrorism in the United States by making use of military commissions in the United States. The article treats of the beginnings of military commissions which were cited in reference to the presidential Military Order on Detention, Treatment, and Trial of Non-citizens in the War against Terrorism, Military Commissions Act of 2006 and Military Commissions Act of 2009 in the context of their compliance with the norm of international humanitarian law and the USA law.
