One of the foundations guaranteeing the efficient operation of courts in the Commonwealth of Poland and Lithuania was adherence to the principles related to the organisation of court registers. The author presents issues related to the registers based on a study of resolutions of the Permanent Council. The source documentation gathered made it possible to investigate the questions most frequently submitted by applicants and the decisions that the Council made in their case. Moreover, the cases quoted in the resolutions provide an interesting picture of the attitude of the noble community towards the problem of common and codified law in the second half of the 18 th century.

Eine der Grundlagen, die die reibungslose Tätigkeit der Gerichte zu Zeiten der Ersten Republik Polen sicherte, war die Einhaltung der Organisationsregeln der Gerichtsregister. Der Autor stellt die Problematik der Register durch die Analyse der Beschlüsse des Ständigen Rates dar. Das gesammelte Quellenmaterial erlaubt eine Einsicht in die von den Antragstellern am häufigsten erhobene Zweifel und Entscheidungen, die in dieser Materie der Ständige Rat traf. Die in diesen Beschlüssen angesprochenen Umstände geben auch eine interessante W iderspiegelung der Haltungen des polnischen Adels gegenüber der Problematik des Gewohnheits- und des positiven Rechts in der 2. Hälfte des 18. Jahrhunderts.
