Ustawa z dnia 7 kwietnia 2017 r. o zmianie niektórych ustaw w celu ułatwienia dochodzenia wierzytelności dokonała m.in. ułatwień w zabezpieczeniu roszczeń. Wprowadzona w tym zakresie nowelizacja dotyczy w szczególności przesądzenia przez ustawodawcę skutku nieważności czynności prawnej dokonanej wbrew udzielonemu zabezpieczeniu (dodany art. 7523a i 7564 k.p.c.). Artykuł przedstawia stan prawny istniejący przed i po wejściu w życie powołanej ustawy. W poprzednim stanie prawnym brak było przepisu regulującego tę kwestię, co powodowało liczne spory w doktrynie i orzecznictwie co do charakteru sankcji. W obecnym stanie prawnym spór ten został rozwiązany poprzez unormowanie expressis verbis w kodeksie postępowania cywilnego skutków naruszenia zakazu zbywania lub obciążenia nieruchomości lub spółdzielczego własnościowego prawa do lokalu.

Th e Act of 7 April 2017 on amending certain acts to facilitate the recovery of receivables has, among others, facilitations in securing claims. Th e amendment introduced in this regard concerns, in particular, the prejudice of the legislator to the eff ect of the invalidity of a legal transaction carried out contrary to the security provided (added Articles 7523a and 7564 of the Code of Civil Procedure).
